Any model, performer or other individual that appears in any depiction of explicit sexual acts shown on the website found at hotmom.tv was eighteen years of age or more at the time of the creation of those depictions.

Exemption: Content Produced by Third Parties

For the purposes of 18 U.S.C. § 2257, the owners and operators are not the primary or secondary "producers" of any content depicting explicit sexual acts, real or simulated, posted on the website. The actions of owners and operators of the website are confined to the transmission, storage, retrieval, hosting, or formatting of content, which may be sexually explicit, that is provided by third-party users. All portions of the website that offer such user contributed content are under the control of the relevant users. The operators of hotmom.tv are therefore free from compliance with Section 2257 records keeping and labeling obligations as set out in 28 C.F.R. §75.1(c)(4). Any content on the website that, at the sole discretion of the operator, is held to be illegal, unlawful, obscene, defamatory, or which in any manner violates the website's terms of use or other policies may be removed.

The visual depictions displayed on the website are exempt from the provision of 18 U.S.C. §§2257, 2257A and/or 28 C.F.R. §75, because: 1) they do not portray activity as specifically listed in 18 U.S.C §2256 (2)(A) (i) through (iv); 2) they do not portray activity as specifically listed in 18 U.S.C. §2257A produced after March 19, 2009; 3) they do not portray activity listed in 18 U.S.C. §2256(2)(A)(v) produced after March 19, 2009; 4) the visual depictions were created prior to July 3, 1995.
